The reason none of the senators pushed your argument that the separate but equal issue should apply to military recruitment on campus is because it simply does not. It has nothing remotely to do with it. What does discriminating against black kids in schoos in the 1950's have to do with the military recruitng on a college campus? Nothing in the mind of even areasonably intelligent 10 year old. I do not know how anyone could be as stupid as you and keep a job.

Hers how you cure the problem. Re-Instate The Military Draft. Instead of the military setting up store fronts on college campus the military should just send out invitations to join them for 2 years in Afganastan or Iraq. Students go to Harvard to avoid Military Service in the first place. A invitation from The President would take care of the issue. I lived through The Viet-Nam Era. I carried a Draft Card,and I still have it in my wallet to this day.Receiving a draft notice in the mail would fix the problem period.

But you're forgetting one important aspect-that the civil rights laws of the last half century apply only as punitive sanctions against the white majority.And the military is still largely composed of white guys,and is hated by the oddballs of our nation. The Supreme Court may have ruled that race discrimination is unconstitutional, but that fact has not dampened the Fed Governments aggressive application of the Affirmative Action program, via its own hiring practices, and the Justice Depts. sanctions on private business, as a result of "discrimination" lawsuits. Affirmative Action-which is racial discrimination,is the working model,and law of the land. Laws may be wrong,harmfull, and destructive, but the fact that they might be unconstitutional or not, is the Supreme Courts,the lawyers, playground.We, the majority, take it on the chin and have no recourse.Kagan is a mediocre shlub, but chances are she will wind up on the Big Bench.And make an important ruling-exonerating the military for its own affirmative action B.S. if the Ft.Hood muslim murderer is ever brought to trial.I'd bet on it.

The thing that really bothers me about Kagan is how long it will be before she comes out of the closet. It shouldn't matter if she is gay. It shouldn't be an issue. No one should have to ask if she is gay and it isn't any one's business. So how come she doesn't come out now? So far no one has asked her, and she's not telling. Don't ask, don't tell. I thought she didn't like that policy.

As you may have heard, that's unconstitutional. She was actually upholding the law and Thurgood Marshall would no doubt have been proud of her. Besides, the military shouldn't be on campuses anyway. Long live the Queen.

Americans voted for Obama, but failed to understand all the other positions that fall under the Executive, Legislative, and Judicial venues. This case in point, and all other future appointees. Democrats want a Democratic Supreme Court nominee and vice versa, but most Americans don't consider this while voting in a Presidential election.

And so they did. And so Kagan is part of the Socialism fall out. And we don't just get to deal with her for 4 years, we get her for the rest of her life.

Bob you can point a finger at our senators all you want about missing the point of the "separate but equal", but they are ELECTED officials. It means we, and our fellow citizens (including some of the numb minds who've posted here already this morning)put them in office.

This is what we get. So let's stop blaming our elected officials. Let's start looking at how we can reach the lazy people in this country who will NOT study civics or our great history.

Funny how you never bothered to mention why she did what she did---because the military believes that gays can not serve in our military openly.

Not one word from you about how gigantically discriminatory the military is on this matter and how they should be banned from open recruiting representation on any freedom minded institution in America.

The military sets a great example for our country in most respects. In this area of gays being allowed to serve openly the military is setting a deplorable example supported only by the cruelest of bigoted jackasses.

When so many good things are said about our military the last thing you want them doing is endorsing bigotry towards gays. And there are no if's, and's, or but's about it, bigotry towards gays is the military policy.

A military that fights for freedom should damn sure not be discouraging it.

Somewhat off topic but . . . .

What the hell is wrong with your president? He was not satisfied with destroying NASA and 50 years of achievement, now he has turned into another feel good social engineering arm of big brother government. For the love of you know who, NASA is supposed to actually be doing things like sending men to Mars, not sending good will ambassadors out across this planet to make Muslims feel good about their technical achievements. And those would be the abacus and perfecting the upstroke for be-headings, right?

True to form, this, and I hate to use the term because of the implied insult to others who have held the office, president has taken one of the proudest endeavors, one of the jewels of the crown of American technical prowess and turned it into a federal version of the Oprah show. Gone are the days of conquest to be replaced with hand holding. Gone are the days when the American flag 'flew' over other worlds to be replaced with the flag of 'feel-goodism' that has served the Black community so well. Gone are the days when men like Neil Armstrong left foot prints on the surface of the moon to be replaced by billions of happy well adjusted Muslims busily oppressing women and non-Muslims the world over.

This man was, in 2008, clearly not qualified to be president and daily confirms that sad fact.

If it wasn't for their efforts involving many varied personal sacrifices along the way, you wouldn't have the freedom to go to a school or college of your choice whether here or abroad. You need to educate yourself about what the U.S. military has accomplished throughout it's history.

Kittynana, you asked - My main problem with serving in the military with gays is that people are housed according to gender. I would have to sleep with, share a bathroom with, work with, and spend virtually all of my time with women who were sexually attracted to me. It would be even worse for men, since I think they shower together. That's just disgusting. Would I want to share intimate quarters like that with men? Most certainly not. So what do you do, house gays separately? Would I want my daughters roomed with lesbians in college? No! It's the same thing.

Really, the shear arrogance to declare a policy that was thoroughly (excruciatingly so), determined upon, by not only a Congress and Prez Willie, but also in conjunction and consultation with the U.S. Military. It is precisely another example of academe run amok. Not to mention that the affected students were ones winding up their Harvard days, ie. in the 22yr old range. What, they need Mommy to discriminate against the military to show them they in her opine discriminate? Next, you'll tell me a 'child' can be on my health policy until the tender age of 26. Really, 75% of these supposed brilliants are but rote memorizors. Does everybody need to be an ivy-leaguer in this admin? What has it brought? Often, these types bring myriad options wanting in decisiveness. The Gulf debacle, mismanagement of Israel and Karzai(remember when it was said 'thank God we have Karzai'?), unfunded Obamacare and Cap/Trade, losing court cases at every turn(next up Holder vs Arizona knockout city), to profligate spending to debt explosion. I know libtards say 'how can repubs talk of spending...look at Bush!', yeah, right, he was one ivy leaguer who had the economy percolating. Low unemployment, 52 straight months of growth, etc. His deficits? Yo, take out the necessary war costs (nec in respect to 99-1 in congress, U.S. & Brit intel, Tony Blair, etc. voting for)that were unwanted by any Prez, and...should be removed if we are considering the effect of policy on economy, and...it is close to having it right. Twice elected GWB messed up with the elder prescript mandate for sure, I'd like to see Repubs push to take that back. Lastly, where Prez Obama really misses the boat, to me, is the concept of 'earned success' and its subsequent residuals. All the giveaways in the world never amount to a hill of beans.

Correct me if I'm wrong but isn't that a law passed by Congress? So how is that at all the military if it was civilian leadership that instituted that policy?

That was just a good cover for her. The military is a job, and why should there recruiters not be allowed the same rights as Microsoft or Bob's Local Office Supply?

Personally, those of us that haven't served should be damn proud of our recruiters. Otherwise it would be your kids, your grandkids, or yourself being forced into service instead of a 100% volunteer army.

“Don’t ask, don’t tell” is “separate and unequal.” You are correct that private stuff ought to remain private, but that is not the practical reality. Straight people are blind to the many ways they publicly flaunt their sexuality, like wedding rings, family photos, bringing spouses to work functions, even referring to spouses by name or pronoun in conversation (which telegraphs the spouse’s gender). Gay soldiers can try to keep their private lives private all they want, but if a third party reports an indiscretion—even off the base and after hours—they risk losing their careers. Despite the second half of “Don’t ask, don’t tell,” there is plenty of telling going on, not necessarily by the gay soldiers themselves. If “Don’t ask, don’t tell” is to be truly equal, then straight soldiers would be required to mask their sexuality, too. After all, private stuff is nobody’s business and should remain private. For everyone. Until displays of all sexuality, not just homosexuality, are restricted in the military, “Don’t ask, don’t tell” will continue to be separate, unequal, inherently discriminatory, unconstitutional, and morally indefensible.

As to #10—Never mind the sexist superficiality of your comment, but I’ll play along. How about Barbara Boxer, Elizabeth Holtzman, Geraldine Ferraro, former Utah state rep Christine Johnson, or feminists Gloria Steinem (former Playboy bunny), Naomi Wolf, and Susan Faludi? Hollywood and the entertainment industry get dissed regularly by conservatives as hotbeds of vacuous liberals, but apparently are ignored when hot bods are at issue: Jane Fonda, Jessica Lange, Charlize Theron, Cheryl Crow, the Dixie Chicks, etc. And despite conservative cuties like Megyn Kelly and Laura Ingraham, the right needs a lot of beauty to counterbalance Ann Coulter, Maggie Thatcher, and Gayle Ruzicka.

The military thing was an isolated incident that came about because of a political choice made by one person. Brown v. Board was about institutional racism! It was about legally changing a large, nation wide system that was unjust and it impacted millions of people who belonged to one group. This lady giving a couple of guys a hard time is not even CLOSE to the same thing. Were they discriminated against because of the organization they belonged to? Yes, obviously they were. Was it the same thing as segregation and jim crow laws? No, not at all! Come on Bob. Seriously.

Editor's Note: you don't understand brown. it was not about the quality of the education, it was about the location of the education. the government cannot segregate, and neither can government-funded universities.

"Separate is inherently unequal". You point this out as Kagan's failure, while refusing to recognize the bigger picture: Kagan was protesting the military's "Don't ask, don't tell" policy - another form of "separate but inherently unequal". So Kagan responded in kind, with "separate but inherently unequal" recruiting conditions for military recruiters.

The military was wrong to issue such an edict, Kagan was right to stand up to blatant discrimination.

Your Republican "gays are bad" mentality is severely clouding your judgment here, Bob.
